Ventura County is not one driving environment but several. Simi Valley and Moorpark commute east through the 118 and the 23. Thousand Oaks and Camarillo move along the 101 over the Conejo Grade. Oxnard runs agricultural and port traffic on the 1 and the 101, with farm equipment and produce trucks sharing roads with commuters. Ventura, Santa Paula and Fillmore string along the 126 and the 33 through a corridor that carries heavy trucks between the coast and the interior. The injuries that follow look different in each of those places, and so does the evidence a claim depends on.

What to do after an injury in Ventura County

  1. Get examined the same day, even if you feel able to go home. Symptoms from a highway speed impact often surface the next morning.
  2. Confirm which agency responded, the city police department, the Sheriff’s Office or CHP, and write down the report number before leaving.
  3. Photograph vehicle positions, debris, skid marks, lane markings, signage and road conditions, along with any nearby cameras.
  4. Ask in writing that week for any video to be preserved, whether it belongs to a store, a transit operator, a farm operation or a parking structure.
  5. If a public entity, a public vehicle or a road condition was involved, note it right away. The six month claim rule moves quickly.
  6. File a DMV form SR-1 within ten days if there was an injury or more than $1,000 in property damage, as Vehicle Code 16000 requires.
  7. Speak with an attorney before giving any recorded statement to an insurance company.

Injury cases we handle in Ventura County

Car accident claims across the county divide roughly between freeway and surface street cases. A collision on the 101, the 118 or the 23 turns on lane position, closing speed and chain reaction, while a case on Los Angeles Avenue, Victoria Avenue or Thousand Oaks Boulevard usually comes down to a left turn, a driveway entry and competing accounts.

Freight moves constantly on the 101 and the 126, and a truck accident claim brings the Federal Motor Carrier Safety Regulations into the case: hours of service limits, maintenance and inspection history, and electronic logging device data a carrier is only required to keep for a limited period. A written preservation demand goes out early so that data still exists when the case needs it.

Pedestrians are hurt regularly on the county’s wide arterials, and pedestrian accident claims rest on Vehicle Code 21950, which requires drivers to yield in marked and unmarked crosswalks. Coastal and inland cycling is heavy year round, and a bicycle accident claim starts with Vehicle Code 21200, giving riders the rights and duties of drivers, and Vehicle Code 21760, requiring three feet of clearance when passing. Motorcycle accident claims on the 101 and PCH begin with the fact that lane splitting is lawful under Vehicle Code 21658.1.

Rideshare accident claims depend on what the driver was doing at impact, since Public Utilities Code 5433 sets a limited policy while a driver waits with the app on and a one million dollar policy while the driver is en route to or carrying a passenger. Public transit and school transportation cases follow a different track, and a bus accident claim against a public agency is generally subject to a written claim within six months under Government Code 911.2.

Off the road, slip and fall claims at the county’s malls, markets and parking structures turn on notice: whether the owner knew or should have known about a hazard and whether it was repaired or warned about, under the duty of care described in Rowland v. Christian. The worst cases in any category are the ones that end in a wrongful death claim, where Code of Civil Procedure 377.60 sets out who may bring the action and a separate survival claim may exist under Code of Civil Procedure 377.30.

Where Ventura County cases are handled

Policing varies by city. Oxnard, Ventura and Simi Valley have their own police departments. Thousand Oaks, Camarillo, Moorpark, Fillmore and the unincorporated areas are served by the Ventura County Sheriff’s Office, in several cities under contract. Collisions on the 101, the 118, the 23, the 126, the 33 and Pacific Coast Highway are generally investigated by the California Highway Patrol.

Emergency care generally means Ventura County Medical Center or Community Memorial Hospital in Ventura, St. John’s Regional Medical Center in Oxnard, Adventist Health Simi Valley in the east county, or Los Robles Regional Medical Center in Thousand Oaks. Keep every discharge instruction, imaging order and billing statement. The record created in the first two weeks after an injury usually carries more weight than anything reconstructed later.

If a claim cannot be resolved and a lawsuit becomes necessary, Ventura County cases are filed in the Ventura County Superior Court. Civil matters are generally heard at the Hall of Justice in Ventura at 800 South Victoria Avenue, and some East County matters are generally handled at the courthouse in Simi Valley. Government claims deserve their own note. If the responsible party is the county, a city, a transit agency or Caltrans, whether for a road defect, a signal problem or a public vehicle, a written claim is generally due within six months under Government Code 911.2, not the two years that applies to an ordinary claim.
