What to do after an injury in Calabasas

Frequently asked questions
A driver passed too close and I went down without contact. Is that a claim?
Possibly. A collision is not required. If a driver’s unsafe pass violated the three foot rule in Vehicle Code 21760 or otherwise created the hazard that caused the fall, that conduct can support a claim. Witness accounts and any video from a head unit or following rider become central.
I was not wearing a helmet. Does that end my case?
No. California follows pure comparative negligence after Li v. Yellow Cab, so a share of fault reduces recovery rather than barring it, and helmet use is a separate question from who caused the crash. Adult cyclists are not required to wear one, and motorcycle helmet law under Vehicle Code 27803 does not decide fault.
How long do I have to file?
Generally two years from the date of injury under Code of Civil Procedure 335.1. If a public entity is responsible, for example a dangerous road condition, a written claim is generally due within six months under Government Code 911.2.
